Woman Awarded US$8,000 After Winning Case Against One Who Ruined Her 20-Year Marriage by Having an Affair with Her Husband

Elizabeth Masvimbo has won a legal battle against Natasha Masvimbo, receiving US$8,000 in damages for an affair that allegedly ended her 20-year marriage.

The High Court found Natasha responsible for having an affair with Elizabeth’s husband, Martin Masvimbo.

Justice Arny Tsanga stated that Elizabeth had proven, on a balance of probabilities, that the affair caused her significant emotional and financial distress.

Elizabeth testified that her marriage to Martin, which had been loving and stable until 2023, began to decline when Natasha became involved.

She reported that Martin started staying out late, skipped family events, and reduced his financial support.

Elizabeth mentioned finding receipts for expensive gifts and overhearing conversations between Martin and Natasha.

She recalled Martin saying his ancestors were urging him to take a second wife, which led to his departure from their home.

Natasha denied the claims, asserting that Martin was her half-brother and that their father had introduced her to the family in 2015.

However, the court found her explanation lacking credibility due to the absence of DNA evidence or any documentation supporting their alleged sibling relationship.

Witnesses corroborated Elizabeth’s story, including a neighbor who claimed Martin introduced Natasha as his wife.

Further evidence showed that Natasha had taken on the surname Masvimbo and was listed as Martin’s wife on his medical plan, which undermined her defense.

Justice Tsanga dismissed Martin’s explanation for this as implausible.

Justice Tsanga highlighted the importance of adultery cases in protecting the sanctity of marriage and awarded Elizabeth US$4,000 for loss of companionship and another US$4,000 for damage to her dignity.

The ruling noted the public humiliation Elizabeth faced within her community and church due to her husband’s actions.

Martin’s claims that Elizabeth used traditional healers to harm him were deemed unfounded.

According to Herald, the court found no evidence supporting this defense and characterized it as a misunderstanding of his behavior.

Justice Tsanga concluded that Elizabeth suffered considerable emotional and financial harm from the affair, reinforcing the relevance of adultery claims in Zimbabwean law.

Natasha has been ordered to pay Elizabeth US$8,000 and cover the costs of the legal proceedings.
