Reckless Force Costs Officer 10 Years in Prison After Fatal Shooting

A police officer has been sentenced to 10 years in prison by the High Court in Chinhoyi after fatally shooting a suspect through a closed bedroom door during an attempted arrest in Berejena Village, Makonde.

Talent Mabvuwo, who had served in the Zimbabwe Republic Police for 15 years, was convicted of murder with constructive intent for the killing of Douglas Sivaminyile on 9 May 2024.

The court found that Sivaminyile, who was wanted for multiple violent assault cases, had locked himself inside a bedroom when Mabvuwo fired three shots through the door without issuing a warning or assessing the threat.

Evidence presented showed that Sivaminyile posed no immediate danger to the officers, and post-mortem results contradicted Mabvuwo’s claim that the suspect had attacked them with an axe.

Justice Phildah Muzofa ruled that Mabvuwo acted recklessly and failed to consider safer alternatives, such as calling for reinforcements.

The court emphasized that the officer should have foreseen the risk of death and exercised restraint, especially in a situation where minimal force could have been used.

In mitigation, Mabvuwo’s clean service record, family responsibilities, and financial support to Sivaminyile’s family during the funeral were taken into account.

However, these factors were weighed against the lasting impact of the killing, particularly on Sivaminyile’s disabled child, who relied on him for daily care.

The sentence was handed down with the aim of balancing justice, deterrence, and mercy, while reinforcing the principle that law enforcement officers must uphold the right to life and follow proper procedures during arrests.
