How the Incident Came to Light
Mushawati lived in a council housing complex, where he shared a home with his two sisters and parents, while the victim’s family resided in a neighboring house.
According to him, he was suddenly accused of inappropriate behavior toward the child and confronted by community members.
The matter was escalated to the police, leading to his arrest and trial.
Court Proceedings and Sentencing
Initially charged in 2015, Mushawati admitted to the offense in court but faced delays in sentencing due to a medical evaluation requested by the magistrate.
He failed to return to court for years, prolonging the case.
In 2021, he was sentenced to 12 years in prison by Harare regional magistrate Hoseah Mujaya.
However, four years of the sentence were suspended on the condition that he did not commit a similar offense within five years, ultimately reducing his jail term to eight years.
During sentencing, Magistrate Mujaya acknowledged Mushawati’s physical disability but emphasized that his actions required punishment, as they put the child at risk of serious harm.
