“lf Your Wife Takes Your Property After Divorce, You’re Not Smart” – Lawyer Sparks Debate

A Nigerian lawyer, Samuel Gift Onyinye Ola, has ignited discussions on social media after advising men on how to safeguard their assets before marriage to prevent legal claims during divorce.
In a Facebook post shared today, she stated that any man who loses part of his property to his wife after separation is “not smart.”
Onyinye recommended that men establish irrevocable trusts and register properties in their children’s names to ensure they remain separate from marital assets.
She emphasized that timing is crucial—if the trust is created before marriage, it is more likely to be considered separate property.
However, if it is established during the marriage, it may still be subject to division.
Her statement has generated mixed reactions online. Some social media users support her advice, calling it a strategic financial move, while others argue that it undermines trust in marriage.
Critics believe such measures could lead to suspicion between spouses, while supporters see it as a necessary step to protect wealth.
Legal experts have also weighed in, noting that while irrevocable trusts can offer protection, courts may still scrutinize them, especially if they appear to be structured to evade equitable distribution.
The debate continues as individuals weigh the ethical and legal dimensions of asset protection in marriage.
