Deadly Mistake or Murder? 8-Year-Old Charged After Cousin’s Shooting

An eight-year-old boy has been charged with murder after allegedly shooting and killing his seven-year-old cousin using a licensed firearm belonging to his father.
The tragic incident occurred just after midday on Thursday, 2 October 2025, in Nothintwa locality, Ngcwanguba Administrative Area, Mqanduli, Eastern Cape, South Africa — a quiet village now shaken by grief and disbelief.
According to the South African Police Service (SAPS), the child accessed the firearm from his father’s bedroom before pointing it at his cousin.
A single shot was fired, and the younger boy collapsed, dying instantly.
Police confirmed the charge in a statement released the following day:
“Cases of murder and negligence/failure to safeguard a firearm have been opened at Kwaaiman police station after the fatal shooting of a seven-year-old boy by his eight-year-old cousin using his father’s licensed firearm.”
Despite his age, the boy has been formally charged and placed in the care of social workers.
However, authorities have not yet clarified whether the shooting was accidental, reckless, or intentional — a silence that has left families, legal experts, and the broader public deeply unsettled.
The central question remains: did the child understand the consequences of his actions?
In addition to the murder charge against the child, his 48-year-old father is also facing legal consequences.
He was arrested for failing to secure the firearm but later released on warning.
He is expected to appear before the Mqanduli Magistrate’s Court, where prosecutors will argue that his negligence directly contributed to the tragedy.
“A case of murder was opened against the eight-year-old boy whilst failure to safeguard firearm charge was laid against the 48-year-old father,” SAPS added.
The case has triggered emotional reactions across communities in South Africa and Zimbabwe.
Social media platforms have been flooded with outrage, sorrow, and disbelief, as many questioned the justice system’s approach to charging a minor.
“How does an eight-year-old even face a murder charge? He is just a child,” one user posted.
Another added, “Children should never have access to firearms. This is tragic. #ResponsibleFirearmUse must be enforced.”
Legal experts and child rights advocates are now closely monitoring the case, raising concerns about whether the justice system can fairly prosecute a child so young.
Police spokesperson Captain Welile Matyolo confirmed that investigations are ongoing, and further details will be released as they emerge.
As the region mourns the loss of a young life, the case has reignited urgent calls for stricter firearm safety laws and greater parental accountability.
The tragedy stands as a painful reminder of the deadly consequences of unsecured weapons and the devastating ripple effects they leave behind.
